Are the municipalities rendered more obligations?

Although two months have passed, attention to this system is not dicreased. Especially continually discussions in the Parliament on municipality system could be concidered as a step in advantage of common work. But if we pay attention to the points proposed in discussions we see that it is not so. That is, some of amendments has symbolical character. It could be accepted as amendment for sake of amendment…
Nowadays there is no talk about discretions in disscussions in the Parliament, but considered amendments for municipality legislation could help in a range of sense. But to present these points in society as fundemental amendment is false. New elected members of municipalities expect more obligations and financial directions and elimination of gaps in the legislation by the Parliament.
So, officials of the Parliament say that, render account by municipalities in the Parliament will play an important role in prevention of spend allocated money for illegal purposes. If the talk about the subsidy allocated by the State, according to the legislation financial and methodical control over this process is in power of Ministry of Finance. Does it says that the Parliament takes another obligation also?
The second point: in accordance with amendent “ municipality can be dissmissed earlier if a decision come to force by the court which says that municipality act contrasts with the Constitution and Constitutional law, dicrees of the President of Azerbaijan, and decisions of Ministry of Cabinets and during a month and amendment or annulment is not taken”. If we want to increase responsibility of municipalities is it important to limit its competence and also earlier dismission? And how it can give profit for the common work? Will the realization of the process take additional allocations? This point can be accepted as increase of works of CEC. We think that it would be better to put responsibility on municipalities in different ways in the amendment, also in accordance with this process impose of fine sanction.
Third point: “Municipalities can be dismissed earlier if the municipality meeting is not held during three month or if half of members do not attend in municipality meetings”. This amendment also belongs to symbolical amendments. We think that if the member of municipality respects oneself he cannot do so. And if somebody does so, then in this case fine sanction is more purposeful. If we pay attention to amendments we can see that dissmission of municipalites is more voiced as punishment measure. But realization of this process is under question. We can cosider that amendments were not completely and comprehensively disscussed.
But why it is difficult to render obligations and financial directions to municipalities although that exists?
Today giving flat communal services to municipality section is discussed. But officials also don’t hurry up to give final decision over this problem. Let’s discuss the situation of flat communal service of the capital firstly, because giving flat communal services to municipality competences is one of the first competences given to local bodies. Today 7000 men work as a yard-keeper in 11 regions, 3000 men in high posts in this sphere. The number of yard-keepers can be increased with the help of “dead”. The most interesting is how 70% of yard-keepers who work in this system and get 75-80 manat official salary, duty salary 85-90 manat buy cars which cost 30 thousand manats? According to the information we have communal service fee is collected from population in Yasamal region equals to 230 thousand manats during a year. Coming to Baku this figure equals to 1,7 million manats. If to add grant given by the government the figure will rise much. After investigation that we carried out we came to a conclusion that people who work in this sphere earn their money from illegal building realized in the capital. There is often information in media about the abolition of amounts through “broom” operations in Regional Communal Flat Unions and centralization of this sphere. It should be noted that there are nearly 200 “JEK”s in Baku. Not transparent situation, many negative events show that cooruption also exists in this sphere. It is confirmed by surveys carried out by many NGO’s. So it can be concluded that special interests to the mentioned sphere impedes the development and transfering this sphere to municipalities.
As it is seen former soviet system is getting worse and decompose. And it is impossible to stop this process. So, the best choice in this case is to abolish it and give material and technical basis to municipalities. Taking into consideration of giving control authority over the process to municipalities there can be created Joint Stock Companies and through this municipalities will be transfered into self-supporting basis. Of course, mentioned suggestions both are significant and can tackle the development of this sphere. In both cases a yard-keeper working in this system will not get 75-80 manat salary.
Taking into consideration above mentioned thoughts it is concluded that later giving additional competence to municipalities will reduce their development chances. It is a pity that struggle against monopoly of municipality system is still continuing.
