The document drawn up by the artist’s lawyers confirms that Fairey actually used the AP photo while depicting the Obama’s portrait. The suit says nevertheless that it was a question of so-called “conscientious use”. The AP representatives state commenting on Fairey’s suit that the parties have made an attempt to patch up the controversy extrajudicially. According to them, the agency voluntarily assumed not to appeal to the court unless the negotiations are finished. The AP representatives say Fairey’s suit became the bolt from the blue for them. They state the agency is going to vindicate their rights.
